ARTICLE 1. DEFINITIONS

1.1 General Terms and Conditions (hereinafter referred to as: the 'Terms and Conditions'): the following delivery and payment terms apply to all sales via ArtuNapoli.com. You agree to this when you place an order.

1.2 Company: ArtuNapoli.com (hereinafter referred to as: 'ARTU NAPOLI Rotterdam') is a trade name of ARTU NAPOLI Rotterdam and is an online store that offers clothing and related products for 'distance selling' to consumers.

Fashion Republic Retail BV trades under the name Artu Napoli Rotterdam.

Fashion Republic Retail BV is registered with the Chamber of Commerce for Southwest Netherlands under number 55408443 and VAT number NL851695097B01.

1.3 Consumer: a natural person or company that concludes a distance contract with the entrepreneur.

1.4 Agreement: a distance contract between ARTU NAPOLI Rotterdam and the consumer.

ARTICLE 2. APPLICABILITY

2.1 These conditions apply to every offer from ARTU NAPOLI Rotterdam and to every distance contract concluded between the company and the consumer.

2.2 These Terms and Conditions apply to all proposals, orders and agreements concluded when using the ArtuNapoli.com website.

2.3 Before the distance contract is concluded, these conditions will be made available via our website. Accepting a proposal or placing an order implies that these conditions have been accepted.

2.4 Deviation from the provisions in these conditions is only possible by means of written agreement. In the event of deviation from part of these conditions, the remaining provisions remain in full force and effect. The consumer cannot derive any rights from any agreed deviations with regard to future transactions.

2.5 Unless otherwise stated in writing, the general or specific terms or conditions of third parties are not recognized by ARTU NAPOLI Rotterdam.

ARTICLE 3. AGREEMENTS

3.1 An agreement is only concluded after acceptance of your order by ARTU NAPOLI Rotterdam. ARTU NAPOLI Rotterdam is entitled to refuse orders or attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, this will be communicated within seven (7) working days of receipt of the order, stating the reasons.

ARTICLE 4. PRICES

4.1 All proposals from ARTU NAPOLI Rotterdam are without obligation. ARTU NAPOLI Rotterdam expressly reserves the right to change prices, especially if this is required on the basis of (legal) regulations.

4.2 The prices stated for the products offered are expressed in EUR, including VAT. Shipping costs are not included in the stated prices (unless otherwise stated). Prior to the conclusion of the agreement, the total price will be communicated via our website.

4.3 Shipping costs will not be charged for shipments within the Netherlands and Belgium. The contribution to shipping costs for customers from countries other than the Netherlands and Belgium depends on the country. An overview of these costs per country is available upon request.

4.4 ARTU NAPOLI Rotterdam cannot be bound to incorrect price indications, for example as a result of data entry errors, typographical errors or printing errors. No rights can be derived from unlawful price information.

ARTICLE 5. PAYMENTS

Payment is always made in advance and in full and is processed by Pay.nl

Payment can be made in various ways as described below and as indicated during the ordering process. Further (payment/order) conditions may be imposed on a consumer's order. After placing an order, the consumer immediately receives a confirmation by e-mail stating the total costs.

iDeal: If you use internet banking from ABN AMRO, ASN Bank, Friesland Bank, ING, Rabobank, SNS Bank, SNS Regio Bank or Tridios Bank, you can pay securely electronically via our website.

An electronic payment via the internet can be compared to a PIN payment in a store. After you have placed your order, choose the iDeal payment method. A window will open where you can select your online banking bank. You then follow the procedure you are used to when paying via internet banking. In principle, the payment is processed on the same day. For more information, please refer to the iDeal website.

Direct and online by credit card payment (Maestro / Mastercard / Visa / Vpay).

Your payment is authorized online so you know immediately whether it has been approved or not. There are no additional charges for payments made by credit card.

Bancontact / Mister Cash

This is a payment method especially for our Belgian customers. Simply via your own bank with your debit card. Safe and secure!

When paying, choose Bancontact / Mister Cash in the shopping cart, enter your card number and the expiry date of the debit card. The window of your own bank will then appear as you are used to and you can enter the other details for further identification.

Mister Cash is an online payment system for Belgian customers. Currently, more than 90% of Belgian banks are affiliated with this online payment system. Payments with Bancontact / Mister Cash on the internet are optimally secured, as you are used to from your own bank (usually via a digipass or card reader). This is a security module that your bank offers you when you use internet banking. The amount will be debited directly from your current account and we will be informed immediately by your bank so that your order can probably be shipped on the same day (depending on the time).

In the event of insolvency or suspension of payment of the consumer (or a corresponding petition or request), the claims of ARTU NAPOLI Rotterdam expire immediately.

If ARTU NAPOLI Rotterdam has to outsource its claim for collection, the consumer is obliged to pay a fixed amount equal to 15% of the principal amount due in extrajudicial collection costs. If ARTU NAPOLI Rotterdam can demonstrate that it has necessarily incurred higher costs, these costs will also be borne by the consumer.

ARTICLE 6. SHIPPING

6.1 Delivery is free for shipments within the Netherlands and Belgium, unless an order contains discount products and/or the total order amount is less than EUR 100.00. The contribution to shipping costs for customers from countries other than the Netherlands and Belgium depends on the country. An overview of these costs per country is available on request.

All products from the online store are in stock. Unfortunately, it may happen that a product is unexpectedly no longer available; in that case we will inform the consumer immediately.

6.2 ARTU NAPOLI Rotterdam strives to ship all orders within 1 to 3 working days after receipt of payment. This is done via UPS or POST.NL to the specified delivery address during the ordering process. If the delivery time is different for certain reasons, the consumer will receive a notification by e-mail. However, in principle, an order is always shipped within 1 to 3 working days after receipt of payment.

6.3 Exceeding the stated delivery time does not entitle the consumer to compensation, termination of the agreement or non-fulfillment of any obligation arising from this agreement or any related agreement.

6.4 The order must be delivered to the consumer no later than 30 days after the order. If it is not possible to deliver an order within 30 days, the consumer will be informed of this in a timely manner and in that case the consumer has the right to cancel the order free of charge. This does not apply if the parties have agreed on a different delivery time.

6.5 Delivery in parts is permitted.

6.6 ARTU NAPOLI Rotterdam's delivery obligation is fulfilled once delivery has been offered.

6.7 If the offered delivery is refused or is not collected, the return freight and storage costs and the risk of damage or loss of the shipment are entirely borne by the consumer.

6.8 Products offered are depicted and/or described clearly and truthfully and as completely as reasonably required. However, color, type, text and/or price changes may differ from reality.

6.9 ARTU NAPOLI Rotterdam is never liable for consequential damage.

ARTICLE 7. RESERVATION OF TITLE

7.1 Ownership of delivered products will only be transferred to the consumer once he has paid everything he owes to ARTU NAPOLI Rotterdam under the agreement(s) relating to the delivered products.

ARTICLE 8. EXCHANGES / RETURNS OF PRODUCTS

8.1 We make every effort to inform you about the products via our website. If you nevertheless do not wish to purchase a product without giving reasons, you have the right to return and/or exchange the product within 14 working days of receiving the order.

8.2 During this period, the consumer must handle the product and packaging with care. The consumer may only unpack the product to the extent necessary to assess whether he or she wants to keep the product. If he or she wishes to exercise his or her right to return or exchange, he or she must return the product with all accompanying accessories to the entrepreneur and, where reasonably possible, undamaged and in the original condition and packaging, in accordance with reasonable and clear instructions.

8.3 ARTU NAPOLI Rotterdam only accepts exchanges/returns for which the instructions have been followed. Exchanges not received within the specified period will not be accepted.

8.4 Your return will be confirmed by email upon receipt of the goods. The purchase amount of the exchange will be refunded to the account from which the amount was debited within 14 working days.

ARTICLE 9. COMPLAINTS

Complaints regarding the delivery and/or quality of your order.

9.1 We do everything we can to deliver a perfect product. After receiving your order, you must immediately inspect the delivered goods and report any defects in writing immediately. If a garment has not been delivered in accordance with your order or does not meet the description on our website, you must notify us in writing immediately. You can do this by sending an email to webshop@artunapoli.com.

This warranty is void if you have personally attempted to remedy the defect and/or have not followed the user manual and/or user instructions.

If you have these types of complaints about a product you purchased from us, we would like to hear from you. You must report this to us by return mail. You can do this by sending an email to webshop@artunapoli.com.

We will try to resolve the problem with you as quickly as possible. In all cases, the return instructions, as you receive them when reporting your complaint, must be strictly followed.

To ensure that your complaint is handled smoothly, we kindly request that you strictly follow our instructions.

ARTICLE 10. LIABILITY

10.1 Any liability of ARTU NAPOLI Rotterdam, of ARTU NAPOLI Rotterdam staff and products, for all damage of any nature whatsoever, direct or indirect, including trade losses, consequential damage, damage to movable or immovable property or to persons, is expressly excluded. Nevertheless, ARTU NAPOLI Rotterdam is liable for damage caused during the execution of the agreement by third parties.

10.2 ARTU NAPOLI Rotterdam accepts no liability for possible damage resulting from the use of ARTU NAPOLI Rotterdam products.

10.3 Any liability of ARTU NAPOLI Rotterdam towards the buyer is in any case limited to a maximum of the invoice amount that the buyer owes to ARTU NAPOLI Rotterdam on the basis of the relevant agreement.

10.4 ARTU NAPOLI Rotterdam is not liable for misunderstandings, mutilations, delays or incorrect transmissions of orders and communications as a result of the use of the internet or other means of communication in traffic between the consumer and ARTU NAPOLI Rotterdam or between ARTU NAPOLI Rotterdam and third parties to the extent this is related to the relationship between the consumer and ARTU NAPOLI Rotterdam, unless and insofar as there is intent or gross negligence on the part of ARTU NAPOLI Rotterdam.

ARTICLE 11. FORCE MAJEURE

11.1 In the event of force majeure, ARTU NAPOLI Rotterdam is, at its sole discretion, entitled to suspend the execution of a consumer's order or to terminate the agreement without judicial intervention by means of a written notice, and ARTU NAPOLI Rotterdam is not liable for any compensation, unless this would be unacceptable in the given circumstances according to the principles of reasonableness and fairness.

11.2 Force majeure means any shortcoming that cannot be attributed to ARTU NAPOLI Rotterdam because it cannot be attributed to its fault nor is it its responsibility under the law, a legal act or generally accepted practice.

ARTICLE 12. APPLICABLE LAW AND JURISDICTION

12.1 All rights, obligations, proposals, orders and agreements to which these general terms and conditions apply, both between ARTU NAPOLI Rotterdam and the consumer and between ARTU NAPOLI Rotterdam and the consumer to which these general terms and conditions apply, are exclusively governed by Dutch law. .
